FACTA Red Flags Online Training Course

The growth of electronic and internet-based records has given employees access to sensitive customer personal and financial data. It has also dramatically increased the risk that this information could be leaked or stolen—and used by identity thieves. The Red Flags Rule is based on the Fair and Accurate Credit Transaction Act (FACTA) of 2003 and was created by agencies including the Federal Trade Commission (FTC) to help avoid identity theft. This federal regulation requires financial firms and other businesses that handle consumer and business credit data to:

  • Understand the warning signs that may indicate identity theft
  • Have and follow a plan to detect the kinds of suspicious activity
  • Take specific actions whenever a red flag is detected
  • Re-evaluate our program periodically to reflect and respond to new risks
Not surprisingly the rule also requires employers to train “relevant employees”—which the FTC notes usually involves employees at every level in the organization. It also provides for stiff fines for each violation and opens the potential for private lawsuits, including the potential for class actions.
